Terms and Conditions
The rules for using Treasure Idaho: accounts, listings, community features, awards voting, the gem hunt, affiliates and paid placements.

These Terms and Conditions ("Terms") are an agreement between you and the operator of Treasure Idaho, doing business as Treasure Idaho ("we", "us"), for the site at treasureidaho.com (the "site"). They cover the whole site: city and listing pages, stays, homes, builders, businesses, jobs, community features, Best of Idaho awards, the gem hunt, shop and deals pages, dashboards, forms and emails we send.
Please read them. They include a limitation of liability (section 18) and say how disputes are handled (section 20). Our Privacy Policy explains how we handle personal information.
1. Accepting these Terms
By using the site or creating an account you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the site. If you use the site for a company or other organisation, you agree on its behalf and confirm you have authority to do so.
2. Who can use the site
You must be at least 13 years old to create an account. If you are under the age of majority where you live, you may use the site only with the involvement of a parent or guardian who agrees to these Terms. You may not use the site if we have previously banned you, or if the law forbids you from doing so. Best of Idaho voting has additional eligibility rules (Idaho only); see section 10.
3. Your account
- Give accurate information and keep it up to date. One person per personal account.
- You can sign up with email and password (when enabled) or with Google or LinkedIn (when offered). You are responsible for keeping your password and sign-in accounts secure, and for everything that happens under your account.
- Tell us straight away through the contact form if you think someone else has accessed your account.
- Business, builder, stay, realtor, shop and instructor pages can be claimed only by people authorised to represent that listing. Realtors must provide a valid Idaho license number and brokerage when required. We may ask for proof, and we may refuse or revoke a claim.
- You can stop using the site at any time. To close your account, use the contact form.
4. Acceptable use
Treasure Idaho is for discovering and celebrating Idaho. Keep it useful and civil. You agree not to:
- Harass, threaten, bully, stalk, dox or intimidate anyone, or post hate speech or content that attacks people for who they are.
- Post spam, unsolicited ads or repetitive self-promotion, or misuse messaging and lead forms for bulk outreach.
- Post anything illegal, or that promotes illegal activity, violence, self-harm, or the exploitation of children. Sexual content is not allowed.
- Post content you do not have the right to share, including other people's copyrighted work, trademarks, trade secrets or confidential information.
- Share someone else's private information without their permission.
- Impersonate any person, company or organisation, or misrepresent your affiliation, license, brokerage, or the products or property you offer.
- Post false or misleading information, fake reviews or ratings, or undisclosed paid promotion (see section 13).
- Manipulate Best of Idaho voting (multiple accounts to stuff ballots, VPNs or proxies to fake an Idaho location, coordinated fraud, or any attempt to bypass Idaho-only or one-vote-per-category rules).
- Use the gem hunt to trespass, dig where collecting is forbidden, enter closed areas, or endanger yourself or others.
- Upload malware, or try to probe, scan, break or bypass the site's security, rate limits or access controls.
- Scrape, crawl, harvest or bulk-download the site, member profiles or contact details, or use them to build a competing database or to train AI models, except as allowed by our robots.txt for search engines or with our written permission.
- Buy, sell or transfer accounts, or create accounts to evade a suspension.
- Use the site to break any law, including real-estate, consumer-protection, export-control, sanctions and anti-spam laws.
5. Your content
You own your content. Posts, comments, photos, reviews, profile information, claim materials, messages and other material you submit ("your content") remain yours.
The licence you give us. You grant us a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, copy, display, reproduce, adapt (for example, resize or crop images, or format text), publish and distribute your content, in order to operate, improve and promote the site. This includes showing public content to logged-out visitors and search engines, and sharing links and previews of public content on our own social channels. The licence ends when you delete the content or your account, except for copies others have already shared, content in shared spaces (such as conversations), reasonable backup retention, and where we must keep it by law.
Your promises. You confirm that you have the rights needed to post your content and grant this licence, that your content follows these Terms, and that it does not violate anyone's rights or any law. Photos and reviews must be honest and based on your own experience unless clearly labelled otherwise.
6. Moderation, removal and termination
We are not obliged to monitor content, but we may review, refuse, edit for formatting, hide or remove any content, and restrict, suspend or close any account, at any time, if we believe it breaks these Terms, creates risk or legal exposure, or to protect the community. Where practical and lawful, we will tell you why.
To report content or a profile, use the contact form. If you think we removed your content or restricted your account by mistake, contact us and we will take another look.
Sections that by their nature should survive termination (including content licences for already-shared content, disclaimers, limitation of liability, indemnity and dispute terms) survive.
7. Copyright complaints (DMCA)
We respect intellectual property rights and respond to notices of alleged infringement under the U.S. Digital Millennium Copyright Act (DMCA). If you believe content on the site infringes your copyright, send a written notice through our contact form (choose a copyright topic if available) that includes:
- your physical or electronic signature;
- identification of the copyrighted work you say is infringed;
- identification of the material you want removed and where it is on the site (URL);
- your name, address, telephone number and email address;
- a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent or the law; and
- a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act for the owner.
Designated agent for notices: Treasure Idaho, 141 N. Palmetto Ave, Eagle, Idaho 83616, USA; use the contact form for electronic notices. We will close accounts of users who repeatedly infringe copyright, in appropriate circumstances. Knowingly false notices or counter-notices can create liability for damages under 17 U.S.C. § 512(f).
8. Our content and trademarks
Except for your content and third-party material, the site and its content, design, text, graphics, logos (including the Treasure Idaho name and marks) and software are owned by us or our licensors and protected by law. You may view and share links to the site for personal, non-commercial use. You may not copy, republish or commercially use our content without permission. Company, builder, realtor and product names and logos belong to their owners; use on the site is to identify and describe them and does not imply endorsement.
9. Listings, claims and real estate
Accuracy. Listing information (homes, communities, stays, businesses, jobs, events and similar) is provided for information. Claimants and contributors are responsible for the accuracy of what they submit. We do not guarantee that any listing is complete, current or error-free.
Not a brokerage; no MLS feed yet. Treasure Idaho is not a real-estate brokerage, realtor, agent or MLS. We do not provide brokerage services, and we do not currently redistribute Multiple Listing Service (MLS) data. Homes and open houses posted by verified realtors or builders are user- or partner-supplied information. Nothing on the site is an offer of sale, a guarantee of availability or price, or a substitute for advice from a licensed Idaho real-estate professional, attorney or tax advisor. Always verify details with the listing agent, builder or host before you rely on them.
Stays. Availability requests are expressions of interest routed to hosts, not confirmed bookings, until the host confirms. Hosts set their own house rules, cancellation policies and pricing off-platform when applicable.
Claims. Claiming a page does not transfer ownership of the underlying business. We may revoke a claim that is inaccurate, unauthorised or abusive.
10. Best of Idaho awards and voting
Best of Idaho ballots and results are a community feature. Voting is limited to people located in Idaho, checked using IP-based location on the server. You must be signed in; one vote per category per account per year. Votes generally cannot be changed once cast. Vote counts and standings are public.
Anti-fraud. We may refuse, remove or disregard votes that appear fraudulent or that break these Terms (including ballot stuffing, fake accounts, or attempts to appear in Idaho when you are not). Awards and badges are promotional recognition from Treasure Idaho; they are not a certification, inspection or warranty of any business.
11. Gem hunt safety
The gem hunt is a free, optional game. Stones appear only between 7:00 a.m. and 5:00 p.m. Boise time (America/Boise), at parks, public businesses, hotels, event locations and other public spots sponsors choose. A stone on the map is a game token, not a permit, trail guide or invitation to enter private property.
By playing you agree that:
- You will only go where the public is allowed; ask permission if you are not sure; follow posted rules and business hours; stay on paths; and never dig or pick up real rocks where collecting is not allowed.
- You will not trespass, block traffic, or endanger yourself or others. Daylight hours only.
- You assume the risks of outdoor activity (uneven ground, weather, traffic, wildlife and similar). To the fullest extent permitted by law, you participate at your own risk.
- Optional device location is used only to help you play; turn it off anytime in your browser or device settings.
Parents and guardians are responsible for minors who play. Sponsored stones and deals do not change these safety rules.
12. Third-party links and affiliates
The site links to and embeds content from other companies, including employers, sellers, map and video providers, and booking pages. Buttons that say shop, apply or visit take you off the site. Those companies are responsible for their own sites, products, prices, jobs and policies. Your dealings with them are between you and them.
Treasure Idaho participates in affiliate programs through affiliate networks and other referral links. When you click an affiliate or shop link and buy something, we may earn a commission, at no extra cost to you. Affiliate links carry a sponsored relationship attribute and are disclosed on the page (for example: we earn a commission when you buy through these links). Commissions do not buy fake reviews. Prices and availability come from sellers and can change; check the seller's site before you buy.
13. Sponsored content, boosts and paid plans
Sponsors pay for placements marked "Sponsored" (including gem hunt sponsorships). Featured or boosted placements may be sold or granted as promotions. Editorial and community rankings are separate from paid placement unless labelled.
Billing. When paid subscriptions, boosts or sponsorships are offered, payment is handled by a third-party processor. Full card numbers are not stored on Treasure Idaho. Online payment is not live until we enable the processor; until then you may submit a request that we review without being charged.
Renewal and cancellation. If a recurring paid plan is offered, the checkout or order confirmation will state the price, billing period and how to cancel. Cancel before the renewal date to avoid the next charge, using the method described at purchase or by contacting us through the contact form. Boosts sold for a fixed date range end when that range ends.
Refunds. Unless a specific offer says otherwise at checkout: (a) fees for a boost or sponsorship that has already run or begun to run on its booked dates are not refundable; (b) if we cancel a paid placement before it runs for a reason other than your breach of these Terms, we will refund the unused portion or offer a make-good at our option; (c) if the payment processor issues a chargeback, we may suspend related placements while it is resolved. For any other refund request, use the contact form within 14 days of the charge and we will review it in good faith. Consumer rights that cannot be waived under applicable law still apply.
14. Jobs and employers
Job listings typically come from employers' own public job boards or are submitted as labelled briefings. We are not the employer, recruiter or agent, and a listing is not an offer of employment. Apply on the employer's site when a link is provided. We do not verify every listing and cannot guarantee it is accurate, current or still open. Never send money or sensitive personal documents to anyone solely in response to a job listing; report suspicious listings through the contact form. Employer tools that contact job seekers on the site deliver Treasure Idaho messages; they do not hand your email to the employer unless you choose to share it.
15. Feedback
If you send us ideas, suggestions or feedback, we may use them without any obligation to you.
16. Changes to the site
Much of the site is free to use and is always changing. We may add, change, suspend or stop any feature or the whole site at any time, with or without notice. Paid features, when offered, are described at purchase.
17. Disclaimers
THE SITE AND ALL CONTENT, LISTINGS, AWARDS, MAPS, HUNT FEATURES AND TOOLS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT CONTENT POSTED BY MEMBERS OR THIRD PARTIES, OR THE PRODUCTS, HOMES, STAYS, JOBS OR EVENTS OF THIRD PARTIES. OUTDOOR AND TRAVEL ACTIVITY CARRIES INHERENT RISK. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.
18. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE OPERATOR OF TREASURE IDAHO, DOING BUSINESS AS TREASURE IDAHO, AND ITS OWNERS, EMPLOYEES, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM OR RELATED TO THE SITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SITE IS LIMITED TO THE GREATER OF US $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, gross negligence or wilful misconduct, or, where applicable, for death or personal injury caused by negligence. If you are a consumer in the EEA or UK, you keep the mandatory rights your local law gives you.
19. Indemnity
To the extent permitted by law, you will defend, indemnify and hold harmless us and our owners, employees, contractors and agents from any claims, losses, liabilities, damages, costs and expenses (including reasonable attorneys' fees) arising from your content, your use of the site (including the gem hunt and voting), your listings or claims, or your breach of these Terms or of anyone's rights.
20. Governing law and disputes
These Terms are governed by the laws of the State of Idaho, USA, and applicable U.S. federal law, without regard to conflict-of-law rules.
Talk to us first. Before filing a claim, please contact us through the contact form and try to resolve the dispute informally for at least 30 days.
Courts. If we cannot resolve it, any claim must be brought in the state courts located in Ada County, Idaho, or the U.S. District Court for the District of Idaho, and you and we consent to their jurisdiction. Either of us may instead bring an individual claim in small-claims court if it qualifies. If you are a consumer in the EEA or UK, you may also bring proceedings in the courts where you live, and the mandatory consumer protections of your country still apply.
Any claim must be brought within one year after it arises, unless the law requires a longer period.
21. General
These Terms and the Privacy Policy are the entire agreement between you and us about the site. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms; we may transfer ours in connection with a merger, sale or reorganisation. There are no third-party beneficiaries.
22. Changes to these Terms
We may update these Terms. We will change the "Last updated" date at the top and, for material changes, tell signed-in members on the site or by email before they take effect where practical. If you keep using the site after changes take effect, you accept the new Terms. If you do not agree, stop using the site and close your account.
